Voting rights are a fundamental right for residents in long-term care. According to federal rules for nursing homes, facilities must protect residents’ rights as U.S. citizens and must support residents in the exercise of their rights.
Here is what every resident, family member, and advocate needs to know:
Unimpeded Right to Vote: Nursing homes are required under federal regulations (42 C.F.R. § 483.10(b)) to ensure residents can exercise their right to vote — or choose not to vote — without coercion, discrimination, or reprisal.
Choice of Assistance: Residents who need help registering or casting a ballot have the right to receive assistance from a person of their choosing — whether that is a family member, Long-Term Care Ombudsman, or facility staff (where permitted by state law).
Protection Against Misconduct: Facilities are strictly prohibited from unauthorized actions, such as registering residents without their consent or filling out ballots on their behalf without authorization.
